Abstract：Unjust enrichment is one of the statutory debts in civil law．The legislation concerned，however，differs from one country to another because of the deep influence by moral ideas in each country and the different characteristics of two legal families．Therefore，the conflict rule plays an important role in foreign—related unjust enrichment cases．Whether the judgment is appropriate depends whether the conflict rule is reasonable or not．The dissertation is about to take a historical view on the legislation concerned in countries belong to different legal families，make comments on each conflict role，then put forward authors’proposal for legislation．
