Abstract：The trademark law in our country introduced the likelihood of confusion elements in article 57(2) and changed the trademark infringement standards into similarity and the likelihood of confusion.Introducing the likelihood of confusion elements in trademark infringement determination to comply with the trademark law principle is a major progress of the trademark legislation in our country.In the relations of the likelihood of confusion and similarity，the likelihood of confusion and similarity are independent elements in trademark infringement determination in article 57(2).Similarity is the front elements and the likelihood of confusion is the outcome elements.In the meaning and application aspects of the likelihood of confusion and similarity，the likelihood of confusion can explain and judge from three aspects of subject，degree and types.The trademark of similarity and the goods of similarity should be in the physical sense，and should not be the similarity on the likelihood of confusion context.Meanwhile，in the trademark infringement determination，the proof standards of similarity should not be set up too strict.
