Abstract：According to the principle of leased house decoration and its legal consequences under the Section 9 to 13 of the ju-dicial interpretation [ 2009 ] No. 1 1，it's improper to ignore the principle of unjust enrichment. In aspect of the interpre-tation theory, litigant should be allowed to cite unjust enrichment principle of civil law as well as the principle of tort lia-bility、 breach of contract liability、 contract fault liability 、 compensation culpa compensation and risk burden of the existinglaw in our country. In aspect of legislation, the relevant provisions of the judicial interpretation [ 2009] No. 11 should beamended in the future.
